General Terms and Conditions for Renting the Playground Berlin

Effective from: July 13, 2022

1. Confirmations & Notifications

The tenant must confirm the final details of the rental (e.g., rental duration, times, and preferences regarding setup and infrastructure) at least ten working days before the rental begins or, for short-term bookings, upon accepting the offer. The final expected number of guests must be communicated at least five working days before the rental begins or, for short-term bookings, upon accepting the offer. The tenant must inform Kids Creative Agency upon request about the type of event, names of known guests, and relevant third parties.

2. Rent and Invoice

Rental Price & Cleaning Costs

The rental price and cleaning costs are calculated as indicated on the website or booking platform or as agreed and exclude VAT. These costs are calculated and agreed upon before the rental begins.

Extras

Additional costs for food, beverages, other services from Kids Creative Agency, and miscellaneous items will be charged to the tenant according to the offer/booking platform or consumption.

Price Changes

Kids Creative Agency reserves the right to change prices at any time. Prices from the confirmed offer or those published and applied on booking platforms are binding.

Invoice

All invoices must be paid by the tenant within fourteen days from the invoice date unless otherwise agreed in writing. In the event of delayed payment, Kids Creative Agency may charge interest on the outstanding amount.

3. Cancellation by the Tenant

To cancel a booking, the tenant must inform Kids Creative Agency in writing via email, providing clear booking details and the reason for cancellation. The booking is considered canceled only after confirmation by Kids Creative Agency. Refunds or non-charging of rental fees and other offered prices are based on the following timelines:

30+ days before the rental begins: Full refund / non-charging
15-30 days before the rental begins: 75% refund / non-charging
14-6 days before the rental begins: 50% refund / non-charging
From 5 days before the rental begins: No refund / non-charging

In the event of a booking postponement, 100% of the non-refundable amount will be credited to the tenant. For bookings via third-party platforms, their refund policies apply.

4. Cancellation by Kids Creative Agency

Kids Creative Agency may cancel the booking if it could harm the agency's reputation or if the tenant fails to pay the invoice on time.

5. Safety, Permits & Nighttime Quiet Hours

The tenant is fully responsible for the safety of their guests during their stay at the Playground. For events, the tenant must obtain any necessary permits. For evening events, the tenant and their guests must adhere to nighttime quiet hours (from 10:00 PM).

6. Liability of Kids Creative Agency

Kids Creative Agency is not liable for personal, material, or other damages that occur during the use of the Playground. The tenant agrees to indemnify Kids Creative Agency.

7. Damages & Losses

The tenant is liable for damages caused by themselves, their guests, or admitted third parties to the Playground, adjacent facilities, common areas, and building facade. This includes damages to equipment, furniture, fixtures, surfaces, ceilings, floors, and carpets, or other items. The tenant is also responsible for the loss of equipment, furniture, and other items. All damages and losses must be reported immediately to Kids Creative Agency.

8. Handover

Kids Creative Agency will hand over the space to the tenant in a clean, orderly, and fully equipped condition as agreed. The agency is responsible for providing all furnishings, materials, food, and beverages as agreed with the tenant.

9. Return

The Playground must be left in an orderly condition. Waste, paper, glass, and PET bottles must be disposed of in appropriate bins. Workshop materials, including flipchart paper and post-it notes, must be removed from walls, taken away, or properly disposed of. Aside from cleaning, the Playground must be returned in the same condition it was handed over by Kids Creative Agency. If the Playground is excessively dirty compared to agreed use, additional cleaning costs may be charged.

10. Smoking

Smoking is not permitted in the Playground.

11. Booking Platforms

For bookings made via third-party platforms, the terms and conditions of the booking platform take precedence, followed by the Playground's terms and conditions.

12. Marketing

By accepting the offer or paying the invoice, the tenant agrees to receive marketing emails from Kids Creative Agency. Tenants can unsubscribe from the email list by clicking a button in the email.
